Apoolco GmbH Pool+Wellness takes the protection of personal data very seriously. For this reason, compliance with the statutory provisions on data protection is a matter of course for us. In the following, we would like to briefly explain what it means for you when you use our personalised services on this online shop and we receive data from you.

What personal information do we receive?
When you use one of our personalised or interactive services, we ask you for various personal data. Personal information includes your real and full name, address, postal address, telephone numbers, company name, e-mail address, etc. The provision of this data is always voluntary on the part of the user. This personal information is stored by us on a protected server.

Do we pass on information to third parties?
Apoolco itself only uses your personal information within the online shop (newsletter dispatch, my account, etc.) or in the processing of customer enquiries or purchase transactions. We appreciate the trust you place in us and take the utmost care to protect your personal data. This data is not passed on to third parties and is treated in strict confidence in accordance with the provisions of the Data Protection Act 2000 (unless we are legally obliged to disclose it!). The data will only be analysed and used to maintain the customer relationship.

Forwarding for order processing
The personal data collected by us will be passed on to the transport company commissioned with the delivery (parcel services, forwarding agents) as part of the contract processing, insofar as this is necessary for the delivery of the goods. In addition, certain order-related basic information (e.g. delivery status) is collected and passed on to a service provider commissioned by us for processing in order to provide a tracking function (shipment tracking). We also pass on your personal data to suppliers commissioned by us as part of order processing. Contract data processing and confidentiality agreements have been concluded with these suppliers.

Forwarding for payment processing
We pass on your payment data to the authorised credit institution or the respective payment service provider as part of the processing of payments.

Forwarding for the sending of advertising material
We pass on your data to external service providers for the sending of Apoolco advertising material. Your data will not be passed on to third parties for external advertising purposes.

Disclosure to public authorities or by court order
By order of the competent authorities, we must provide information about personal data (inventory data) in individual cases, insofar as this is necessary in fulfilment of corresponding legal obligations for the purposes of criminal prosecution, to avert danger or for other reasons.

Credit check, proof of identity and address verification
The customer is obliged to provide the data requested in the online shop (names, addresses, company name, VAT number, etc.) completely and correctly when registering and during the order or payment process and to inform Apoolco immediately of any future changes or to make changes in his/her customer account independently. Apoolco is entitled to demand appropriate proof or advance payments to verify the identity, address and creditworthiness of the customer. In the event of demonstrably and/or wilfully incorrect information or failure to disclose changes (e.g. creditworthiness etc.), the customer is liable to Apoolco for the resulting damages. Apoolco is also repeatedly entitled to check the customer's details and creditworthiness or credit standing by obtaining information from authorised organisations (credit protection association, banks, credit agencies, etc.). The customer declares his express consent that his data may be transmitted to the officially authorised organisations and/or credit institutions for the purpose of credit checks. Customers can revoke this consent informally at any time.

Amendment of the guidelines
We reserve the right to amend these guidelines at any time in compliance with data protection regulations. If these changes affect you, we will inform you by e-mail. The Austrian Data Protection Act applies.

Data utilisation policy
If the opportunity for the input of personal and valid data (e-mail addresses, name, address) is given, the input of these data takes place voluntarily. The use of all services offered is - as far as technically possible and reasonable - also permitted without providing such data or by providing anonymised data or a pseudonym.
The use of contact data such as postal addresses, telephone numbers and e-mail addresses published in the imprint, various webpages or comparable information by third parties for the purpose of sending unsolicited information is not permitted. We expressly reserve the right to take legal action against the senders of so-called spam mails in the event of violations of this prohibition.

Integration of the Trusted Shops Trustbadge
The Trusted Shops Trustbadge is integrated on this website to display our Trusted Shops seal of approval and any collected reviews as well as to offer Trusted Shops products to buyers after an order. This serves to safeguard our legitimate interests, which predominate in the context of a balancing of interests, in the optimal marketing of our offer. The Trustbadge and the services advertised with it are an offer from Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne. When the Trustbadge is called up, the web server automatically saves a so-called server log file, which contains, for example, your IP address, the date and time of the call, the amount of data transferred and the requesting provider (access data) and documents the call. This access data is not analysed and is automatically overwritten no later than seven days after the end of your visit to the site. Further personal data is only transferred to Trusted Shops if you decide to use Trusted Shops products after completing an order or if you have already registered to use them. In this case, the contractual agreement concluded between you and Trusted Shops applies.

Contact and service forms
Your details, including personal data from our contact and service forms (cancellation, complaints, general contact form) will be transmitted to us via our own mail server, processed and stored by us in order to process your enquiry. This data will not be collected or passed on without your consent. We cannot process your enquiry without this data.

E-mail advertising with registration for the newsletter
If you subscribe to our newsletter, we will use the data required for this or separately provided by you to regularly send you our email newsletter based on your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR. Unsubscribing from the newsletter is possible at any time and can be done either by sending a message to the contact option described above or via a link provided for this purpose in the newsletter. After unsubscribing, we will delete your email address unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

Apoolco uses technologies such as cookies to customise content and ads, provide social media features and analyse website traffic. We also share information about the use of our online shop with our trusted social media, advertising and analytics partners. Apoolco collects this data to improve the delivery of offers via social networks such as Facebook.
